Terms and Conditions

For all services provided by the E&J Growth Accelerators, established in Curacao, Chamber of Commerce number 160050, the following conditions apply when purchasing video training.

Article 1. Definitions

1. Client: the natural person or legal entity with whom E&J Growth Accelerators enters into an agreement regarding participation in a course.
2. Course participant: the natural person who actually participates in the course on behalf of the client.
3. Online training : E-learning, seminar, webinar, online training, online course, online workshop, with the aim of transferring and/or increasing knowledge and/or skills.
4. Conditions: these general conditions.

Article 2. Applicability

1. The terms and conditions apply to all quotations, general offers, (legal) acts, agreements and the like of E&J Growth Accelerators, regardless of whether they are related to or follow on quotations, general offers, (legal) acts, agreements and the like that have already been made.
2. Een inschrijving voor een online videotraining impliceert aanvaarding va de toepasselijkheid van deze algemene voorwaarden.
3. Changes or additions to the terms and conditions must be confirmed explicitly and in writing by the student.
4. The applicability of the client's general terms and conditions is excluded insofar as they conflict with these terms and conditions.

Article 3. Registration and confirmation

1. The client can register himself or a student of his choice via the website of E&J Growth Accelerators for participation in a training. By registering for a training, the Client accepts the applicability of these general terms and conditions without reservation.
2. Agreements between the Client and E&J Growth Accelerators are only concluded if the registration is confirmed by E&J Growth Accelerators to the Client in writing or digitally.
3. E&J Growth Accelerators has the right to refuse a registration without stating reasons.
4. The student receives a login code that provides access to a personal environment within which the video training(s) can be unlimited. This environment is strictly personal and may not be shared with third parties without permission. Should E&J Growth Accelerators notice that this is happening anyway, a copyright violation will be reported, which can lead to a fine for the client.

Article 4. Pricing

1. Registration takes place by completing the form via the website of E&J Growth Accelerators. The prices apply as stated on the internet at the time of registration.
2. The course prices include the cost of the course material, unless stated otherwise.
3. When registering for a course using the registration form based on a mailing, the prices as stated in that mailing apply.
4. Prices can be adjusted due to unforeseen circumstances
5. Prices will be adjusted in the event of changes in the VAT regime and/or the level of the applicable VAT rates

Article 5. Cancellation/change/payment

1. Payment follows immediately after registration via the website. After payment, the client receives personal login codes and the video training can be followed in a personal environment.
2. If there are technical problems with logging in or the environment, the client must report this within 7 working days by e-mail to folkert@ejgrowthaccelerators.com
3. It is not possible to cancel the purchase of an online video training.
4. Under no circumstances will the purchase amount be refunded unless E&J Growth Accelerators itself decides otherwise.
5. Data for live training can be changed up to 14 days before the start.

Article 6. Costs for Refund Payment and Collection Costs

1. Costs for Refund Payment If a customer refunds a payment, costs will be charged. These costs amount to € 12.10 per reversal and are payable by the customer. These costs are based on the actual costs that we have to incur to handle the reversal. These costs will be deducted from the amount refunded to the customer.
2. Collection costs If an invoice is not paid within 14 days after the due date, the claim will be transferred to a collection agency. The costs associated with this are for the account of the customer and will be charged by the collection agency. The amount of these costs depends on the amount of the claim and is determined by the collection agency.
3. Settlement Any costs for reversal and collection costs can be settled with outstanding invoices or amounts to be repaid.
4. Payment obligation Failure to pay an invoice within the set term does not release the customer from his payment obligation. It is the customer's responsibility to pay on time. If the customer does not pay on time, we reserve the right to transfer the claim to a collection agency.
5. Changes to Terms and Conditions We reserve the right to change these Terms and Conditions. We will inform the customer of this in good time. If the customer does not agree with the amended conditions, the customer has the right to terminate the agreement.

Article 7. Liability

1. E&J Growth Accelerators is not liable for any damage caused by or related to participation in an E&J Growth Accelerators course, unless E&J Growth Accelerators can be blamed for intent or gross negligence.
2. If E&J Growth Accelerators is at any time liable for any damage despite the provisions of paragraph 1, this will be limited to a maximum of the invoice amount.
3. Indirect damage is not compensated.
4. Participation in training is entirely at your own risk. Each participant voluntarily chooses to participate in the training and the activities within the training.
5. E&J Growth Accelerators only has a best efforts obligation and no result obligation. E&J Growth Accelerators can in no way make any statements or give guarantees about possible results through participation in training courses. Any examples of possible results during training are only illustrative and do not bind E&J Growth Accelerators in any way. Trainers and employees of E&J Growth Accelerators maintain a high ethical standard and will provide a realistic picture of the content of the training courses as best they can. The participant remains responsible at all times for the results in his company.
6. E&J Growth Accelerators will do everything possible to provide the best possible training. Nevertheless, it is possible that there have been changes on social media channels and that these have not yet been included in the video training. Layout, options and functionalities can therefore differ in the video training from the appearance of the current platform. E&J Growth Accelerators cannot be held liable for this and no claim can be made to a refund of the purchasing behavior if it is observed by the student.
7. If and insofar as E&J Growth Accelerators should prove liable for any damage, the compensation of that damage is always limited to direct personal and property damage insofar as E&J Growth Accelerators can be attributed. E&J Growth Accelerators is never liable for any consequential damage.

 Article 8. Intellectual property

1. The course material provided becomes the property of the client. The intellectual property rights with regard to the course, the course material and any other documents/products related to the course are reserved by E&J Growth Accelerators.
2. Without the express written permission of E&J Growth Accelerators, the client is not entitled to publish, exploit or in any way reproduce data from and/or parts and/or extracts of the course material provided.

Article 9. Applicable law

1. Dutch law applies to all quotations, general offers, (legal) acts and the like of E&J Growth Accelerators and agreements between E&J Growth Accelerators and the client.
2. All disputes that arise between the parties as a result of a quotation, general offer, (legal) act, agreement and the like, to which these terms and conditions apply or as a result of agreements arising therefrom, will be brought before the competent court in 's- Gravenhage, unless the law prescribes otherwise.

Artikel 10. Instemming

By placing an order or purchasing services from us, the customer agrees to these Terms and Conditions.
