Terms and Conditions

For all services provided by E&J Growth Accelerators, located in Curacao, Chamber of Commerce number 160050, the following terms and conditions apply when purchasing video trainings.

Article 1. Definitions

1. Client: the natural person or legal entity with whom E&J Growth Accelerators enters into an agreement regarding participation in a course.
2. Participant: the natural person who actually participates in the course on behalf of the client.
3. Online training: E-learning, seminar, webinar, online training, online course, online workshop, with the aim of transmitting and/or increasing knowledge and/or skills.
4. Conditions: these general terms and conditions.

Article 2. Applicability

1. The terms and conditions apply to all quotations, general offers, (legal) actions, agreements, and the like of E&J Growth Accelerators, regardless of whether they are related to, or follow from, previously made quotations, general offers, (legal) actions, agreements, and the like that have already been made.
2. Registration for an online video training implies acceptance of the applicability of these general terms and conditions.
3. Changes to or additions to the terms and conditions must be explicitly and in writing confirmed by the participant.
4. Applicability of the client's general terms and conditions is excluded to the extent that they conflict with these terms and conditions.

Article 3. Registration and confirmation

1. The client can register themselves or a participant of their choice via the E&J Growth Accelerators website for participation in a training. By registering for a training, the client accepts the applicability of these general terms and conditions without reservation.
2. Agreements between the Client and E&J Growth Accelerators are only concluded if the registration is confirmed by E&J Growth Accelerators to the Client in writing or digitally.
3. E&J Growth Accelerators has the right to refuse a registration without stating reasons.
4. The student receives a login code that provides access to a personal environment within which the video training(s) can be unlimited. This environment is strictly personal and may not be shared with third parties without permission. Should E&J Growth Accelerators notice that this is happening anyway, a copyright violation will be reported, which can lead to a fine for the client.

Article 4. Pricing

1. Registration takes place by completing the form via the website of E&J Growth Accelerators. The prices apply as stated on the internet at the time of registration.
2. The course prices include the costs of the course materials, unless otherwise stated.
3. When registering for a course using the registration form based on a mailing, the prices as stated in that mailing apply.
4. Prices can be adjusted due to unforeseen circumstances.
5. Prices will be adjusted in case of changes in the VAT regime and/or the applicable VAT rates.

Article 5. Cancellation/change/payment

1. Immediately after registration via the website, payment will be made. After payment, the client will receive personal login codes and can access the video training in a personal environment.
2. If there are any technical issues with logging in or accessing the environment, the client should report this via email to within 7 business days.
3. It is not possible to cancel the purchase of an online video training.
4. Under no circumstances will a refund of the purchase amount be granted, unless otherwise determined by E&J Growth Accelerators itself.
5. The dates for live trainings can be changed up to a maximum of 14 days before the start.

Article 6. Refund Payment Fees and Collection Costs

1. Payment Refund Costs: If a customer refunds a payment, charges will apply. These charges will amount to €12.10 per reversal, and are payable by the customer. These costs are based on the actual costs that we must incur to process the reversal. These costs will be deducted from the amount refunded to the customer.
2. Collection Costs: If an invoice is not paid within 14 days after the due date, the claim will be transferred to a collection agency. The costs associated with this are the responsibility of the customer and will be charged by the collection agency. The amount of these costs depends on the amount of the claim and will be determined by the collection agency.
3. Settlement: Any costs for reversal and collection costs can be settled with outstanding invoices or amounts to be repaid.
4. Payment Obligation: Failure of paying an invoice within the specified term does not relieve the customer of their payment obligation. It is the responsibility of the customer to pay on time. If the customer does not pay on time, we reserve the right to transfer the claim to a collection agency.
5. Changes of Terms and Conditions: We reserve the right to amend these Terms and Conditions. We will inform the customer of such changes in a timely manner. If the customer does not agree with the modified conditions, the customer has the right to terminate the agreement.

Article 7. Liability

1. E&J Growth Accelerators is not be liable for any damage caused by or related to participation in a course offered by E&J Growth Accelerators unless it can be attributed to intentional misconduct or gross negligence on the part of E&J Growth Accelerators.
2. If, despite the provision in clause 1, E&J Growth Accelerators is liable for any damage at any time, such liability shall be limited to a maximum of the invoice amount.
3. Indirect damage will not be compensated.
4. Participation in training is entirely at your own risk. Each participant voluntarily chooses to participate in the training and the activities within the training.
5. E&J Growth Accelerators has an obligation to make efforts only and not an obligation to produce results. E&J Growth Accelerators cannot make any statements or guarantees regarding potential results from participating in training courses. Any examples given about possible results during training courses are merely illustrative and do not bind E&J Growth Accelerators in any way. Trainers and staff of E&J Growth Accelerators adhere to a high ethical standard and will provide a realistic picture of the content of the training courses as best they can. The participant remains solely responsible for the results in their own business at all times.
6. E&J Growth Accelerators will do everything possible to provide the best training courses. However, it is possible that there have been changes on social media platforms that have not yet been incorporated into the video training. As a result, the layout, options, and functionalities in the video training may differ from the appearance of the current platform. E&J Growth Accelerators cannot be held liable for this, and there can be no claim for a refund of the purchase price upon discovery by the participant.
7. If and to the extent that E&J Growth Accelerators should be liable for any damage, the compensation for that damage is always limited to direct personal and property damage to the extent that it can be attributed to E&J Growth Accelerators. E&J Growth Accelerators is never liable for any consequential damage.

 Article 8. Intellectual property

1. The course material provided becomes the property of the client. The intellectual property rights with regard to the course, the course material and any other documents/products related to the course are reserved by E&J Growth Accelerators.
2. Without the express written permission of E&J Growth Accelerators, the client is not entitled to publish, exploit or in any way reproduce data from and/or parts and/or extracts of the course material provided.

Article 9. Applicable law

1. Dutch law applies to all quotations, general offers, (legal) acts and the like of E&J Growth Accelerators and agreements between E&J Growth Accelerators and the client.
2. All disputes that arise between the parties as a result of a quotation, general offer, (legal) act, agreement and the like, to which these terms and conditions apply or as a result of agreements arising therefrom, will be brought before the competent court in 's- Gravenhage, unless the law prescribes otherwise.

Article 10. Consent

By placing an order or purchasing services from us, the customer agrees to these Terms and Conditions.
